1 Scope of application
- These General Terms and Conditions (“GTC”) apply to all contracts concluded between Tanja Gauer (hereinafter referred to as “the Provider”) and her clients via the website and/or online shop.
- The offers are primarily directed at private consumers. In individual cases, entrepreneurs may also conclude contracts.
- Deviating terms and conditions of the client shall not apply unless the Provider expressly agrees to their validity in writing.
2 Services and professional disclaimer
- The Provider offers in particular the following services:
- Live animal communication (1:1 sessions)
- Animal communication via voice message
- Intuitive coaching for humans
- Energy work for humans and animals
- Online courses (live courses and self-study formats)
- Group offerings and frequency spaces
- Mentoring programs
- All services are intended as intuitive, energetic and supportive guidance for humans and animals.
- Any recommendations regarding alternative, energetic or natural healing approaches are provided solely as complementary impulses to conventional medical or veterinary treatment and must be coordinated independently by the client with the attending physician, veterinarian or therapist.
- The Provider does not make medical or veterinary diagnoses, does not provide healing promises, and does not replace medical, psychotherapeutic or veterinary treatment.
- The energetic methods and techniques applied are not scientifically proven and are not recognized by conventional medicine.
- All animal communications, coaching sessions and energetic work are carried out to the best of the Provider’s knowledge and belief. No guarantee can be given for a specific outcome, development or healing.
3 Conclusion of contract
- The presentation of services in the online shop does not constitute a legally binding offer.
- By completing the booking process, the client submits a binding offer to conclude a contract.
- The contract is concluded upon confirmation of the booking by email or upon commencement of service provision.
- The Provider reserves the right to decline bookings, in particular if the requested service lies outside her area of experience (e.g. communication with missing animals). In such cases, no contract shall be concluded or an already concluded contract shall be reversed with a full refund.
4 Appointments and service provision
- Live services are provided at fixed, pre-booked appointments.
- Non-live services (e.g. voice messages or energetic work) are provided within seven (7) days, unless otherwise stated in the offer.
- Courses and group offerings take place on the dates specified in the respective offer.
- The client is responsible for ensuring the necessary technical requirements.
5 Prices and payment
- The prices stated at the time of booking apply.
- Payment is made via the payment methods offered in the online shop (e.g. PayPal).
- When using external payment service providers, their respective terms and conditions apply in addition.
- Services are generally provided only after receipt of full payment.
6 Cancellation and non-attendance
- Live appointments may be cancelled or rescheduled free of charge up to [e.g. 48 hours] before the scheduled start.
- In the event of later cancellation or non-attendance, the full fee shall be due.
- If an appointment is cancelled by the Provider, any payments already made will be refunded in full.
7 Cancellation of courses and group offerings
- The Provider reserves the right to cancel courses or group offerings for important reasons, in particular if the minimum number of participants is not reached or due to illness.
- In the event of cancellation, all participation fees already paid will be refunded in full. Further claims are excluded.
8 Courses, learning outcomes and recordings
- No guarantee is given that a specific learning outcome will be achieved or that a particular goal will be reached through participation in courses, mentoring programs or group offerings. Success depends largely on the participant’s own commitment and engagement.
- Recordings of courses or group sessions may be made available to participants.
- All content (including recordings, audio, video and written materials) is protected by copyright and may only be used for personal purposes. Any sharing, reproduction or distribution is prohibited.
9 Client’s duty to cooperate
- The client warrants that they are entitled to provide and authorize the use of all information, data, texts and images (e.g. animal photos) submitted to the Provider.
- The Provider is not obliged to review the content provided by the client, in particular with regard to its accuracy, completeness or suitability for the intended purpose.
- Delays resulting from insufficient cooperation by the client shall not be the responsibility of the Provider.
10 Right of withdrawal
Consumers are entitled to a statutory right of withdrawal. Details are set out in a separate withdrawal policy.
11 German Distance Learning Protection Act (FernUSG)
- The courses and programs offered do not constitute distance learning within the meaning of the German Distance Learning Protection Act (FernUSG).
- A state approval (ZFU certification) is not required and is therefore not held.
12 Liability
- The Provider shall be liable without limitation in cases of intent, gross negligence and for injury to life, body or health.
- In cases of slightly negligent breach of essential contractual obligations, liability shall be limited to the foreseeable damage typical for the contract.
- Any further liability is excluded to the extent permitted by law.
13 Storage of the contract text
- The client may print or save the contract text before submitting the booking.
- The client receives an order confirmation by email containing all essential contract data.
- The contract text is stored by the Provider but is not made permanently accessible online.
14 Final provisions
- German law shall apply exclusively.
- For contracts with entrepreneurs, the place of jurisdiction shall be the Provider’s place of business in Germany.
- The Provider does not participate in dispute resolution proceedings before a consumer arbitration board.
- Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
